However, Infotrade may decide to take the site down for technical maintenance, in which case users will be notified in advance of the dates and times of maintenance work. The site is regularly updated by Frédéric Pichard. Similarly, the legal notice is subject to change at any time: users shall nevertheless continue to be bound by it and should refer to it as often as possible in order to familiarise themselves with its contents.

The site’s purpose is to provide information on all of the company’s activities. Infotrade endeavours to ensure that the information provided on www.sparklane-group.com is as accurate as possible. However, the company may not be held liable for any omissions, inaccuracies or failings concerning updates, by themselves or by any third party partners who provide such information. Any information featured on www.sparklane-group.com is given as a guide and is subject to change. Moreover, information featured on www.sparklane-group.com is not exhaustive. It is given subject to changes that may have been made since being posted on-line.

 

4. Contractual restrictions on technical data

The site uses Javascript technology. The Website may not be held liable for any material damages arising from the use of the site. Moreover, when accessing the site, the user undertakes to use recent hardware, free from viruses and a latest generation browser with updates installed.

 

5. Intellectual Property and Infringement

Infotrade is the owner of intellectual property rights or holds the rights to use all the components accessible on the site, particularly texts, images, graphics, logo, icons, sounds and software. Any reproduction, representation, modification, publication or adaptation of any or all of the site’s components, by whatever means or process used, is prohibited unless otherwise authorised in writing by: Infotrade. Any unauthorised exploitation of the site or any of its components shall constitute infringement, punishable under the provisions of articles L.335-2 et seq. of the French Intellectual Property Code.

 

6. Limitation of Liability

Infotrade may not be held liable for any direct or indirect damages caused to computer hardware as a result of accessing the site www.sparklane-group.com where such hardware does not meet the specifications given under point 4, nor for the appearance of a bug or incompatibility. Nor may Infotrade be held liable for indirect damages (such as, for example, lost markets or opportunity loss) following the use of www.sparklane-group.com. Interactive spaces (where questions can be entered in the contact form) are available to users. Infotrade reserves the right to remove without notice any content in this space which may contravene legislation applicable in France, in particular any data protection provisions. Where necessary, Infotrade also reserves the right to invoke the civil and/or criminal liability of the user, particularly in the case of messages that are racist, abusive, defamatory or pornographic in nature, whatever the medium used (text, photograph etc.).

 

7. Personal Data Management

In France, personal data are protected in particular under law n° 78-87 of 6 January 1978, law n° 2004-801 of 6 August 2004, article L. 226-13 of the Penal Code and the European Directive of 24 October 1995. Using www.sparklane-group.com may result in the following information being gathered: the URL of links through which the user accessed the site, the user’s internet provider and the user’s internet protocol (IP) address. In any event, Infotrade only collects users’ personal data for the purposes of certain services offered by www.sparklane-group.com. However, Infotrade is unable to check the content of such sites and as such shall not bear any responsibility for them.
